End User License Agreement — MindType: Personality Test
This EULA is a legal agreement between you (“End User” or “you”) and Umay (“Licensor,” “we,” “us,” or “our”), the independent developer of MindType: Personality Test (“App”). The App is licensed to you, not sold.
You acknowledge that this EULA is concluded between you and Umay only, and not with Apple Inc. (“Apple”). Apple is not a party to this EULA and bears no responsibility for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance Apple will have the right to enforce this EULA against you as a third-party beneficiary.
Subject to your compliance with this EULA, Umay grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, as permitted by the Apple App Store Terms of Service.
This license does not permit you to:
The App may offer optional premium features, content, or functionality accessible through in-app purchases or auto-renewing subscriptions (“Premium Content”). Access to Premium Content requires payment of the applicable fee displayed in the App and on the Apple App Store at the time of purchase.
All in-app purchases and subscriptions are processed exclusively by Apple through the App Store. Umay does not collect, store, or process your payment information. By completing a purchase, you also agree to Apple’s applicable payment terms.
If you purchase a subscription, it will automatically renew at the end of each subscription period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You may manage or cancel your subscription at any time through your Apple ID account settings: Settings > [your name] > Subscriptions on your device. Cancellation takes effect at the end of the current billing period; you will retain access to Premium Content until that date. Umay does not offer refunds for partial subscription periods except as required by applicable law or Apple’s refund policies.
If a free trial is offered, the unused portion of a free trial will be forfeited when you purchase a subscription. The paid subscription begins immediately upon purchase confirmation and will auto-renew as described in Section 3.3 unless cancelled.
We reserve the right to change subscription prices. You will be notified of any price change before it takes effect, via the App or the App Store. Your continued use of a subscription after the effective date of a price change constitutes your acceptance of the new price.
You agree to use the App solely for its intended purpose: personal, non-commercial self-reflection and exploration of your decision-making patterns through game theory scenarios. You agree not to:
Umay reserves the right to terminate your license immediately if you violate any provision of this Section.
The App and all of its contents — including but not limited to game theory scenarios, daily dilemma content, the archetype and evolution tier system, cognitive bias detection framework, Decision Stability Score methodology, design, graphics, user interface elements, text, and underlying source code — are owned by or licensed to Umay and are protected by the intellectual property laws of the Republic of Türkiye and applicable international conventions.
You are granted no rights to any intellectual property owned by Umay except the limited license expressly set out in Section 2 of this EULA. “MindType” and associated branding are proprietary to Umay.
The App may offer features that allow you to share your archetype evolution, decision insights, or results to social media platforms. By using such features, you acknowledge that:
Your use of the App is also governed by Umay’s Privacy Policy, available at https://umay.dev, which is incorporated into this EULA by reference. By using the App, you acknowledge that you have read and understood the Privacy Policy.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UMAY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Umay does not warrant that: (a) the App will meet your requirements or expectations; (b) the App will be available, uninterrupted, timely, secure, or error-free at all times; (c) the results obtained from use of the App will be accurate or reliable; or (d) any defects or errors in the App will be corrected.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the App’s purchase price to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty will be Umay’s sole responsibility.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UMAY, ITS AFFILIATES, LICENSORS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, EVEN IF UMAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by applicable law, Umay’s total cumulative liability to you for all claims arising from or related to this EULA or the App shall not exceed the greater of: (a) the total amount you paid to Umay (via Apple) for the App and any in-app purchases in the twelve (12) months immediately preceding the claim; or (b) one US dollar (USD $1.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
Umay is responsible for addressing any product liability claims, claims that the App fails to conform to applicable legal requirements, and claims arising under consumer protection or similar legislation, to the extent required by law. Apple has no responsibility for such claims.
In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party’s intellectual property rights, Umay (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
The App is not directed at or intended for use by children under the age of 13. By using the App, you represent that you are at least 13 years old. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to this EULA on your behalf. We do not knowingly permit children under 13 to use the App. If you become aware that a child under 13 is using the App, please contact us at https://umay.dev.
This EULA is effective from the date you first download or use the App until terminated. Your rights under this EULA will terminate automatically and without notice from Umay if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the App and delete all copies from your devices.
Umay reserves the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice, and will not be liable to you or any third party for any such modification, suspension, or discontinuance.
Sections 5, 8, 9, 10, 11, 14, and 15 shall survive any termination of this EULA.
This EULA and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.
You irrevocably agree that the courts of the Republic of Türkiye shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this EULA. Notwithstanding the foregoing, Umay may seek injunctive or other equitable relief in any competent court worldwide to protect its intellectual property rights or confidential information.
If you are a consumer in a jurisdiction that mandates local consumer protection law or local dispute resolution, nothing in this section limits any rights you may have under those mandatory provisions.
This EULA, together with the Privacy Policy available at https://umay.dev, constitutes the entire agreement between you and Umay concerning the App and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the App.
If any provision of this EULA is held by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No waiver of any provision of this EULA shall be effective unless in writing and signed by Umay. No failure or delay by Umay in exercising any right, power, or privilege under this EULA shall operate as a waiver of that right.
We reserve the right to modify this EULA at any time. We will notify you of material changes by updating the Effective Date at the top of this page and, where appropriate, by providing an in-app notice. Your continued use of the App after the effective date of any modification constitutes your acceptance of the revised EULA. If you do not agree to the revised EULA, you must stop using the App and uninstall it from your devices.
